  1. FERPA Notice: Education Records and School Official Status
  2. Understanding FERPA and Its Limitations

The Family Educational Rights and Privacy Act (FERPA), 20 U.S.C. § 1232g, is a federal law that protects the privacy of “education records” maintained by educational institutions that receive federal funding.

Important: Pathway2Career Consulting LLC is NOT

A school, college, or university

An educational agency or institution

A “school official” under FERPA

Bound by FERPA regulations

FERPA only applies to educational institutions (schools, colleges, universities) and their designated “school officials.” Private educational consultants like Pathway2Career Consulting are not covered entities under FERPA.

  1. How FERPAAffects Information You Share With Us

When you or your school shares education records with us:

  1. Information Leaves FERPA Protection: Once education records are disclosed to us by you or with your consent, they are no longer protected under FERPA because we are not a FERPA-covered entity.
  2. We Are Not a “School Official”: Schools may only disclose education records without consent to “school officials” with a “legitimate educational interest.” We do not qualify as a “school official” under FERPA definitions.
  3. Your Consent Is Required: If your school shares education records directly with us, the school should obtain your (or your parent’s/guardian’s) written consent, as required by FERPA § 99.30.
  4. How We Handle Education-Related Information

Although we are not bound by FERPA, we treat education-related records with the same level of confidentiality and professionalism:

Confidential Treatment: We maintain strict confidentiality of transcripts, test scores, disciplinary records, IEPs, 504 plans, and other educational documents

Limited Use: We use education records solely for providing admissions consulting and career coaching services

Secure Storage: We store educational documents using encrypted cloud storage and secure file sharing platforms

No Unauthorized Disclosure: We do not disclose education records to third parties without your explicit written authorization, except as required by law

Access Controls: Only authorized personnel who need access to provide Services may view education records

  1. Recommendations for Protecting Your Privacy

To minimize sharing of confidential school records:

  1. Provide Summaries: In most cases, we do not need complete official transcripts or full disciplinary files. Summaries, unofficial transcripts, or grade reports are usually sufficient.
  2. Redact Sensitive Information: Before sharing documents, you may redact Social Security numbers, student ID numbers, or other identifiers not relevant to admissions consulting.
  3. Use Secure Methods: When sharing education records, use password-protected files, encrypted email, or secure file-sharing platforms.
  4. Understand Your Rights: If your school discloses education records to us, understand that you are consenting to release those records from FERPA protection.
  5. For Minor Students (Under Age 18)

Parental Consent: If the student is under 18, parents/guardians typically control access to education records under FERPA and must provide consent for sharing information with us.

Age of Majority: Once a student turns 18 or enrolls in postsecondary education, FERPA rights transfer from parents to the student.

If you have questions about FERPA or how your education records will be handled, contact us at [email protected]
